Standard Conditions Of Trading

1 In these Standard Conditions of Trading all references to OMC shall mean and include Online Minicabs & Couriers and (where the context so admits) any servant, agent, self employed courier and subcontractor engaged by it. OMC shall be entitled to engage self employed couriers and /or subcontractors to carry out work undertaken by OMC and on such terms and conditions as self employed couriers or sub contractors may stipulate.

2 In these Standard Conditions of Trading "Client" shall mean the customer who contracts for any services of OMC

3 Every  transaction between OMC and the Client will be governed by these Standard Conditions of Trading and the Standard Conditions of Carriage unless otherwise agreed in writing by OMC before the commencement of any transaction.

4 OMC may from time to time alter the Standard Conditions of Trading  which may supercede previous Standard Conditions of Trading.

5 No variation under these Standard Conditions of Trading shall be effective unless agreed in writing under the hand of a partner of OMC Subject as aforesaid the Directors of OMC will consider quoting special terms on request for the carriage of any chattels or documents in respect whereof OMC's liability would otherwise be limited under these Standard Conditions of Trading.

6 OMC is not a common carrier and reserves the right to refuse to perform any services requested of it without giving reason for its refusal.

7 Services performed by OMC for the Client will be charged on the basis of the prices published in OMC's Tarriff current at the time such services are performed unless otherwise agreed.

8 At the time the client orders any such service, a delivery note will be prepared by OMC which will contain the details of all collection and delivery addresses. The preparation and production of such a delivery note, if in the form customarily used by OMC, shall be accepted by the Client as proof that the order was made by him and satisfactorily completed by OMC unless the Client produces written evidence to the contrary.

9 Any agreed credits must not be deducted from invoices. A credit note will be raised, and this will be the only method of payment discount.

10 Clients must remain within the credit limits set by OMC and OMC reserves the right to suspend services should such limits be exceeded.

11 Accounts in excess of credit (30 days) will be subject to a 2% per month interest charge, calculated on a weekly basis.

12 Closed accounts must be settled in full within seven days. Amounts outstanding after this period will accrue interest at a rate not exceeding 2% per month.

13 These Standard Conditions of Trading refer only to the conduct of a credit account and the documentation arising from transaction  such accounts. They shall not be construed as to alter in any way the effects of OMC's Standard Conditions of Carriage which prevail at all times, copies of which are available upon request.

14 The Client shall be liable for any duties, taxes levies or expenditure of any kind levied by the authorities at any part or place in connection with the chattels or documents consigned and for any loss or damage whatsoever incurred by OMC in connection therewith.

15 OMC reserves the right to pass on all charges for parking fines, clamping and vehicle removal, as imposed by local authorities , when OMC's vehicles are instructed by the Client to wait / load or unload in restricted areas as defined by local authority.

16 In the computation of time provided by these conditions the following days shall not be included, Sunday, Good Friday, Christmas Day or a Bank Holiday.

17 By signature of these Standard Conditions of Trading, as provided for overleaf, Clients are deemed to have notice of the contents hereof and of the contents of OMC's Standard Conditions of Carriage.
